By using our website, you agree to be bound by, and to comply with, these terms of use. This user agreement ( “agreement”) is a contract between you (“you” or “user”) & FindUsOnWeb (“we,” or “us” or “www.findusonweb.com”), its affiliates and the sister concern companies ("FindUsOnWeb" or “FindUsOnWeb” or “Find Us On Web” or “FOW”). FindUsOnWeb provide website features and other products and services to you when you visit or shop at the website, use FindUsOnWeb devices, products, or services, use FindUsOnWeb applications for mobile, or use software provided by FindUsOnWeb in connection with any of the foregoing (collectively "findusonweb services" or “FOW Services”). These terms of use are effective from 16th dec,2017.
This agreement describes the terms and conditions which you accept by using our website or our services. This agreement includes and hereby incorporates by reference the following important agreements, as they may be in effect and modified from time to time: Terms of Use; Cookies Policy; Privacy Policy; FindusonwebMembership Agreement; Copyright Policy; Refer and Reward Terms: and as applicable to any service contract you enter into with another user. These agreements are collectively, with this agreement and the terms and conditions included within, called the “Terms of Service”. The "Terms of Service", govern your access to and use of the FindUsOnWeb website, including any content, functionality and services offered on or through the site or the mobile devices, as applicable.
Please read these terms of use carefully. We recommend that you print off a copy of these terms of use for your records, as well as any future versions of them, as we may update them from time to time. If for any reason whatsoever you do not agree to these terms of use or do not wish to be bound by them, you must not access or use our website.
By using the site, opening an account or by clicking to accept or agree to the terms of service when this option is made available to you, you accept and agree to be bound and abide by these terms of service and our privacy policy. For more detailed policies surrounding the activity and usage on the site, please access the designated articles herein. Subject to the conditions set forth herein, FindUsOnWeb may, in its sole discretion, amend this agreement and the other terms of service at any time by posting a revised version on the site. FindUsOnWeb may provide notice of the important amendment by posting the updated terms of service on the site, by providing notice on the site, and/or sending you notice by email. If the change includes an increase to fees charged by FindUsOnWeb, FindUsOnWeb will provide at least 30 days’ advance notice of the change but may not provide any advance notice for changes resulting in a reduction in fees or any temporary or promotional fee change. Any revisions to the terms of service will take effect on the noted effective date (each, as applicable, the “effective date”).

You acknowledge, agree, and understand that FindUsOnWeb is not a party to the relationship or any dealings between buyer and seller. Without limitation, users are solely responsible for You further acknowledge, agree, and understand that you are solely responsible for assessing whether to enter into a service contract with another user and for verifying any information about another user. FindUsOnWeb You acknowledge, agree, and understand that FindUsOnWebdoes not, in any way, supervise, direct, control, or evaluate sellers or their work and is not responsible for any job, job terms or work product. FindUsOnWeb makes no representations about and does not guarantee, and you agree not to hold FindUsOnWeb responsible for, You also acknowledge, agree, and understand that sellers are solely responsible for determining, and have the sole right to determine, which jobs to accept; the time, place, manner, and means of providing any seller services; the type of services they provide; and the price they charge for their services or how that pricing is determined or set. You further acknowledge, agree, and understand that:
1.     Purpose
The website is a digital marketplace where users buy and sell seller services or products (“classified items”) or post custom requirements (“Jobs”) for sellers to be bid for the job & fulfil the requirement. Buyers and sellers must register for an account in order to buy or sell classified items or use site services. Subject to the terms and conditions, FindUsOnWeb provides the site services to users, including hosting and maintaining the site, facilitating the formation of service contracts, and assisting users in resolving disputes which may arise in connection with those service contracts. The website enables users to work together online to complete and pay for jobs, buy and sell classified items and to use the services that we provide. It is a marketplace where buyers and sellers can identify each other and advertise, buy, and sell seller services online. When a user enters a service contract, the user uses the site to invoice and pay any amounts owed under the service contract on the website. We, at FindUsOnWeb, merely makes the site and site services available to enable sellers and buyers to find and facilitate the direct interaction online with each other. FindUsOnWeb does not introduce sellers to buyers, find jobs for sellers, or find sellers for buyers. Through the site and site services, sellers may be notified of buyers that may be seeking the services they offer, and buyers may be notified of sellers that may offer the services they seek; at all times, however, users are responsible for evaluating and determining the suitability of any job, buyer or seller on their own. If users decide to enter into a service contract, the service contract is directly between the users and FindUsOnWeb is not a party to that service contract. We are not a party to any contractual agreements between buyer and seller in the online venue, we merely facilitate connections between the parties. We may, from time to time, and without notice, change or add to the website or the information, products or services described in it. However, we do not undertake to keep the website updated. We are not liable to you or anyone else if any error occurs in the information on the website or if that information is not current. Before using the website, you must read the whole user agreement, the website policies and all linked information.
2.     Eligibility
You will not use the website if you: All user accounts are associated with individuals. Login credentials should not be shared by users with others. The individual associated with the account will be held responsible for all actions taken by the account, without limitation. Subject to your local laws, a person over 14 but under 18 can use an adult's account with the permission of the account holder. However, the account holder is responsible for all actions taken by the account, without limitation. Users may provide a business name or a company name, which is associated with the user's account. Users acknowledge and agree that where a business name or company name is associated with their account, this user agreement is a contract with the user as an individual as well as the business or company and both remain responsible for all activity undertaken in respect of the account. We may, at our absolute discretion, refuse to register any person or entity as a user. You cannot transfer or assign any rights or obligations you have under this agreement without prior written consent.
      1. Are not able to form legally binding contracts;
      2. Are under the age of 16;
      3. A person barred from receiving and rendering services under the laws of england or other applicable jurisdiction;
      4. Are suspended from using the website; or
      5. Do not hold a valid email address.
3.     Using FindUsOnWeb
While using the website, you will not attempt to or otherwise do any of the following:
      1. Post content or items in inappropriate categories or areas on our websites and services;
      2. Infringe any laws, third party rights or our policies;
      3. Fail to deliver payment for services delivered to you;
      4. Fail to deliver seller services purchased from you;
      5. Circumvent or manipulate our fee structure, the billing process, or fees owed to FindUsOnWeb;
      6. Post false, inaccurate, misleading, deceptive, defamatory or offensive content (including personal information);
      7. Take any action that may undermine the feedback or reputation systems (such as displaying, importing or exporting feedback information or using it for purposes unrelated to the website);
      8. Transfer your FindUsOnWeb account (including feedback) and username to another party without our consent;
      9. Distribute or post spam, unsolicited, or bulk electronic communications, chain letters, or pyramid schemes;
      10. Distribute viruses or any other technologies that may harm FindUsOnWeb, the website, or the interests or property of FindUsOnWeb users (including their intellectual property rights, privacy and publicity rights) or is unlawful, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene, profane or which may harass or cause distress or inconvenience to, or incite hatred of, any person;
      11. Download and aggregate listings from our website for display with listings from other websites without our express written permission, "frame", "mirror" or otherwise incorporate any part of the website into any other website without our prior written authorisation;
      12. Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by us in connection with the website;
      13. Copy, modify or distribute rights or content from the website or FindUsOnWeb's copyrights and trademarks; or
      14. Harvest or otherwise collect information about users, including email addresses, without their consent.
4.     Relationship with FindUsOnWeb
      1. Ensuring the accuracy and legality of any user content,
      2. Determining the suitability of other users for a service contract (such as any interviews, vetting, background checks, or similar actions),
      3. Negotiating, agreeing to, and executing any terms or conditions of service contracts,
      4. Performing seller services, or
      5. Paying for service contracts or seller services.
      6. Does not make any representations about or guarantee the truth or accuracy of any seller’s or buyer’s listings or other user content on the site;
      7. Does not verify any feedback or information provided by users about sellers or buyers; and
      8. Does not vet or otherwise perform background checks on sellers or buyers.
      9. The quality, safety, or legality of seller services;
      10. The qualifications, background, or identities of users;
      11. The ability of sellers to deliver seller services;
      12. The ability of buyers to pay for seller services;
      13. User content, statements or posts made by users; or
      14. The ability or willingness of a buyer or seller to actually complete a transaction.
      15. You are not an employee of FindUsOnWeb, and you are not eligible for any of the rights or benefits of employment (including unemployment and/or workers compensation insurance);
      16. FindUsOnWeb will not have any liability or obligations under or related to service contracts and/or seller services for any acts or omissions by you or other users;
      17. FindUsOnWeb does not, in any way, supervise, direct, or control any seller or seller services; does not impose quality standards or a deadline for completion of any seller services; and does not dictate the performance, methods or process seller uses to perform services;
      18. Seller is free to determine when and if to perform seller services, including the days worked and time periods of work, and FindUsOnWeb does not set or have any control over seller’s pricing, work hours, work schedules, or work location, nor is FindUsOnWeb involved in any other way in determining the nature and amount of any compensation that may be charged by or paid to seller for a job;
      19. Seller will be paid at such times and amounts as agreed with a buyer in a given service contract, and FindUsOnWeb does not, in any way, provide or guarantee seller a regular salary or any minimum, regular payment;
      20. FindUsOnWeb does not provide sellers with training or any equipment, labor, tools, or materials related to any service contract; and
      21. FindUsOnWeb does not provide the premises at which sellers will perform the work. Sellers are free to use subcontractors or employees to perform seller services and may delegate work on fixed-price contracts or by agreeing with their buyers to have hourly contracts for seller’s subcontractor(s) or employee(s). If a seller uses subcontractors or employees, seller further agrees and acknowledges that this paragraph applies to FindUsOnWeb’s relationship, if any, with seller’s subcontractors and employees as well and seller is solely responsible for seller’s subcontractors and employees.
    1. Without limiting the foregoing paragraph, if you are an agency or agency member, you expressly acknowledge, agree, and understand that:

      1. The agency is solely responsible for paying its agency members for work performed on behalf of the agency and that such payments will not be made through the site;
      2. FindUsOnWeb is not a party to any agreement between the agency and its agency members and does not have any liability or obligations under or related to any such agreement, even if the agency or agency member defaults;
      3. Neither agencies nor agency members are employees or agents of FindUsOnWeb, and FindUsOnWeb does not, in any way, supervise, direct, or control the agency or agency member or services performed by the agency or agency member;
      4. FindUsOnWeb does not, in any way, supervise, direct, or control the agency or agency members;
      5. FindUsOnWeb does not set agencies’ or agency members’ contract terms amongst themselves or with buyers (including determining whether the contract will be hourly or fixed price), fees, pricing, work hours, work schedules, or location of work;
      6. FindUsOnWeb does not provide agencies or agency members with training or any equipment, labor, tools, or materials needed for any service contract;
      7. FindUsOnWeb does not provide the premises at which the agency or agency members will perform the work; and
      8. FindUsOnWeb makes no representations as to the reliability, capability, or qualifications of any agency or agency member or the ability or willingness of any agency to make payments to or fulfil any other obligations to agency members, and FindUsOnWeb disclaims any and all liability relating thereto.

Nothing in this agreement is intended to prohibit or discourage (nor should be construed as prohibiting or discouraging) any user from engaging in any other business activities or providing any services through any other channels they choose. Users are free at all times to engage in such other business activities and services and are encouraged to do so.
2.     YOUR ACCOUNT DETAILS
1.     Account Information
Nothing in this agreement is intended to prohibit or discourage (nor should be construed as prohibiting or discouraging) any user from engaging in any other business activities or providing any services through any other channels they choose. Users are free at all times to engage in such other business activities and services and are encouraged to do so.
2.     Account profile
To register for an account to join the site, you must complete a user profile (“profile”), which you consent to be shown to other users and, unless you change your privacy settings, the public. You agree to provide true, accurate, and complete information on your profile and all registration and other forms you access on the site or provide to us and to update your information to maintain its truthfulness, accuracy, and completeness. You agree not to provide any false or misleading information about your identity or location, your business, your skills, or the services your business provides and to correct any such information that is or becomes false or misleading.
3.     Account types
As described in this section, there are a number of different account types. Once you register for one account type, you can add the other account types under the same username and password. For example, if you already have a seller account (defined below), you can add a buyer account as a separate account type in settings without re-registering. You agree not to have or register for more than one account without express written permission from us. We reserve the right to revoke the privileges of the account or access to or use of the site or site services, and those of any and all linked accounts without warning if, in our sole discretion, false or misleading information has been provided in creating, marketing, or maintaining your profile or account.
4.     Buyer account
    1. You can register for an account or add an account type to use the site and site services as a buyer (a “buyer account”). Each user under a buyer account (“team member”) can be given different permissions to act on behalf of the buyer account.
6.     Seller, agency, and agency member account
You can register for an account or add an account type to use the site and site services as a seller (a “seller account”). Another type of seller account you can add is an “agency account”, the owner of which is referred to as an “agency”. An agency account allows permissions to be granted to users under the agency account which can be given different permissions to act on behalf of the agency (each, an “agency member”) You acknowledge and agree that the agency is solely responsible, and assumes all liability, for (a) the classification of your agency members as employees or independent contractors; and (b) paying your agency members in accordance with applicable law for work performed on behalf of the agency for jobs. You further acknowledge and agree that (i) the agency may determine the profile visibility and pricing/rate information of any of its agency members, and (ii) agency members’ profiles may display work history that includes work done under the agency account, including after the agency member is no longer an agency member.
7.     Account permissions
You agree not to request or allow another person to create an account on your behalf, for your use, or for your benefit, except that an authorized employee or agent may create an account on behalf of your business. By granting other users permissions under your account, including as a team member or agency member, you represent and warrant that (a) the user is authorized to act on your behalf, (b) you are financially responsible for the user’s actions taken in accordance with those permissions, including, if applicable, entering into binding contracts on behalf of the owner of the account, and (c) you are fully responsible and liable for any action of any user to whom you have provided any permissions and any other person who uses the account, including making payments and entering into service contracts and the terms of service. If any such user violates the terms of service, it may affect your ability to use the site. Upon closure of an account, findusonweb may close any or all related accounts.
8.     Identity and location verification
When you register for an account and from time to time thereafter, your account will be subject to verification, including, but not limited to, validation against third-party databases or the verification of one or more official government or legal documents that confirm your identity, your location, and your ability to act on behalf of your business on findusonweb. You authorize findusonweb, directly or through third parties, to make any inquiries necessary to validate your identity, your location, and confirm your ownership of your email address or financial accounts, subject to applicable law. When requested, you must timely provide us with complete information about yourself and your business.
9.     Usernames and passwords
When you register for an account, you will be asked to choose a username and password for the account. You are entirely responsible for safeguarding and maintaining the confidentiality of your username and password and agree not to share your username or password with any person who is not authorized to use your account. You authorize findusonweb to assume that any person using the site with your username and password, either is you or is authorized to act for you. You agree to notify us immediately if you suspect or become aware of any unauthorized use of your account or any unauthorized access to the password for any account. You further agree not to use the account or log in with the username and password of another user of the site if (a) you are not authorized to use either or (b) the use would violate the terms of service.
10. Consequences of unauthorised access
Where we provide you with the option to select your own login information, including a password, we recommend that you supply login information unique to your own use of this website, and do not use information from other accounts you may hold with other websites or any easily discoverable information about you. You are responsible for any consequences of unauthorised access to your account due to any disclosure of your login information to any third party.
11. Another user's account
You must never use another user's account without permission. When creating your account, you must provide accurate and complete information. You agree that you will not solicit, collect or use the login credentials of other individuals. We prohibit the creation of, and you agree that you will not create, an account for anyone other than yourself. You also represent that all information you provide to us upon registration and at all other times will be true, accurate, current, and complete. You agree to update your information as necessary to maintain its truth and accuracy.
12. Unauthorised access & access withdrawal
You must ensure that any persons who access our website on your computer(s) or device(s), or who are permitted or able to access our website on your computer(s) or device(s), or who use your internet connection, are aware of these terms of use and all other documentation referred to in them, and that such persons also agree to be bound by and to comply with these terms of use. If for any reason, the persons who do not agree to these terms of use or do not wish to be bound by them, they must not access or use our website, and you must not permit them to do so. We reserve the right to withdraw access to your account without notice for any actual or suspected breach of these terms of use or any other documentation referred to in them, including, without limitation, where we suspect that there has been unauthorised access to your account, or any unauthorised disclosure of your login information.
13. Compromised information
If you know or suspect that the confidentiality of your login information has been compromised, for example, by the disclosure of such information to any third party, you must immediately change your password. If you are unable to change your password, you must immediately notify us by email, at support@findusonweb.com.
14. Registration and acceptance
By registering for an account to use the site or site services (an “account”), by using the site or site services after the effective date if you had an account on the effective date, or by clicking to accept the terms of service when prompted on the site, you agree to abide by this agreement and the other terms of service. To access and use certain portions of the site and the site services, you must register for an account. Subject to the site terms of use, certain portions of the site are available to site visitors, including those portions before your account registration is accepted. Findusonweb reserves the right to decline a registration to join findusonweb or to add an account type as a buyer or seller, for any lawful reason, including supply and demand, cost to maintain data, or other business considerations. If you create an account as an employee or agent on behalf of a company, you represent and warrant that you are authorized to enter into binding contracts, including the terms of service, on behalf of yourself and the company.
15. Account eligibility
Findusonweb offers the site and site services for your business purposes only and not for personal, household, or consumer use. To register for an account or use the site and site services, you must, and hereby represent that you (a) have or are an employee or agent of and authorized to act for an independent business (whether it be as a self-employed individual/sole proprietor or as a corporation, limited liability company, or other entity); (b) will use the site and site services for business purposes only; (c) will comply with any licensing, registration, or other requirements with respect to your business, or the business for which you are acting, and the provision of frecash on referral services; and (d) a legal entity or an individual 18 years or older (or have otherwise reached the age of majority in the jurisdiction in which you conduct business) who can form legally binding contracts.
16. Inactive accounts
User accounts that have not been logged into for a period of time will incur a maintenance fee per month, until either the account is closed or reactivated, for storage, bandwidth, support and management costs of providing hosting of the user's profile, portfolio storage, listing in directories, promotion of your profile on the website and elsewhere, file storage, message transmission, general administrative matters and message and other storage costs. The length of the period and the amount of the maintenance fee is set out in our schedule of fees and charges. We reserve the right to close an inactive account. We reserve the right to close an account with NIL or negative funds.
17. Multiple accounts
To prevent fraud and abuse, users are limited to one active account. Any additional account determined to be created to circumvent guidelines, promote competitive advantages, or mislead the FindUsOnWeb community will be disabled. Mass account creation may result in disabling of all related accounts. Note: any violations to FindUsOnWeb’ S terms of service is cause for permanent suspension of all accounts.
3.     TAXES
1.     VAT
FindUsOnWeb may be required by applicable law to collect taxes or levies including, without limitation, withholding income tax or VAT (while some countries may refer to VAT using other terms, e.g. GST, we’ll just refer to VAT, GST and any local sales taxes collectively as “VAT”) in the jurisdiction of the Seller (the "Taxes"). In such instances, any amounts FindUsOnWeb is required to collect or withhold for the payment of any such Taxes shall be collected in addition to the fees owed to FindUsOnWeb under the Terms of Service. You acknowledges and agrees that you are responsible for paying any direct or indirect taxes, including any GST, VAT or otherwise, which may apply to you depending on residency or location and the income received via selling the goods and services via Find us on Web. for determining whether Seller is required by applicable law to remit to the appropriate authorities any value added tax or any other taxes or similar charges applicable to the Seller Fees and remitting any such taxes or charges to the appropriate authorities, as appropriate;
2.     Income taxes
You are responsible for paying any taxes on the income received from Findusonweb either by selling products or services on the site or any other income received from site including the income received from promotional activities. You acknowledge that you must comply with your obligations under income tax provisions in your jurisdiction on all the income received from us including but not limited to the income earned from the sales and promotions and income received in the form of credit earnings. You acknowledges and agrees that You are solely responsible for all tax liability associated with payments received via FindUsOnWeb and that FindUsOnWeb will not withhold any taxes from payments to Seller;
3.     Other taxes and benefits
You acknowledge and agrees that
      1. You represent and warrant that you comply, and will comply at all times, with your obligations under income tax provisions in your jurisdiction.
      2. The Product price shown on the Product page is inclusive of all such taxes and charges that may apply to the Sellers.
You acknowledge and agrees that You are solely responsible
      1. To obtain any liability, health, workers’ compensation, disability, unemployment, or other insurance needed, desired, or required by law, and that Seller is not covered by or eligible for any insurance from FindUsOnWeb;
      2. For determining whether Seller is required by applicable law to issue any particular invoices for the Seller Fees and for issuing any invoices so required
      3. If outside of the United Kingdom, for determining if FindUsOnWeb is required by applicable law to withhold any amount of the Seller Fees and for notifying FindUsOnWeb of any such requirement and indemnifying FindUsOnWeb for any requirement to pay any withholding amount to the appropriate authorities (including penalties and interest). In the event of an audit of FindUsOnWeb, Seller agrees to promptly cooperate with FindUsOnWeb and provide copies of Seller’s tax returns and other documents as may be reasonably requested for purposes of such audit, including but not limited to records showing Seller is engaging in an independent business as represented to FindUsOnWeb.
4.     FEES & CHARGES
1.     Membership fees
Sellers pay FindUsOnWeb a membership fee if they subscribe for a paid membership. Sellers may subscribe to different levels of participation and privileges on the site, by payment of subscription fees as described in and subject to the terms of the membership page.
2.     Other Fees &Services
We charge fees for certain services, such as introduction fees for jobs, listing upgrades and memberships, which we may change from time to time and will update by placing on our website. We may choose to temporarily change the fees for our services for promotional events (for example, discounts on memberships) or new services, and such changes are effective when we post a temporary promotional event or new service on the websites, or as notified through promotional correspondence. Unless otherwise stated, all fees are quoted in Great British Pounds. Sellers pay FindUsOnWeb a service fee for the use of the site, for using the site’s communication, invoicing, reporting and helping customer bring more sakes and increase their turnover. The service fees to use the site and site services are paid solely by seller. When a buyer pays a seller for a job, buyer purchases a credit from find us on web and seller completes the job as a subcontractor of the offer with a commitment and complete the job and keep the customer on the top of the priority. Once the buyer accepts the delivery of the service purchased, find us on web may cross verify the delivery of the products and services and will credit the seller account via the claim earning functionality of the website for the balance amount after subtracting the FindUsOnWeb service fee. Seller hereby irrevocably authorizes and instructs FindUsOnWeb to deduct the service fee from each completed order and credit the balance amount into seller account on FindUsOnWeb.
5.     FINDUSONWEB ORDER
    1. You acknowledge, agree, and understand that you can place orders from site or the mobile devises and make the payment for the order
    2. You acknowledge, agree, and understand that your order will be created and given a unique order number, once the payment is done &confirmed
    3. You acknowledge, agree, and understand that sellers must trigger the delivery of the delivered order along with completed files and/or proof of work using the “Deliver” Action button located on the Order page of to the job that was purchased in accordance with the job specification advertised and requested by the customer and agreed in the scope.
    4. You acknowledge, agree, and understand that using the “Deliver” button when an order was not fulfilled may result in a cancellation of that order after review, affect the seller’s grading and result in a warning to seller.
    5. You acknowledge, agree, and understand that an order is marked as complete after the order is marked as Delivered and then Accepted and rated by a buyer. An order will be automatically marked as complete if not rated and no request for modification was submitted within 7 days after marked as Delivered.
    6. You acknowledge, agree, and understand that using the Deliver button may not be abused by Sellers to circumvent Order guidelines described in this Terms of Service.
    7. You acknowledge, agree, and understand that when a buyer orders a Product, the seller is notified by email as well as notifications on the site while logged into the account.
    8. You acknowledge, agree, and understand that sellers are required to meet the delivery time they specified when creating their Services. Failing to do so will allow the buyer to cancel the order when an order is marked as late and may harm the seller's status.
    9. You acknowledge, agree, and understand that as a seller you must send completed files and/or proof of work and inform the buyer about delivery using the Deliver button (located on the Sales Order page) and mark the order as Delivered.
    10. You acknowledge, agree, and understand that as a buyer you are responsible for scanning all transferred files for viruses and malware or respective deliverable requested against the order. FindUsOnWeb will not be held responsible for any damages which might occur due to site usage, use of content or the files transferred.
    11. You acknowledge, agree, and understand that a seller may cancel an order without the buyer's consent at any given moment (Force Cancellation). However, this will have a negative effect on the seller's status.
    12. You acknowledge, agree, and understand that buyers may use the "Request Revisions" feature located on the Order page while an order is marked as Delivered if the delivered materials do not match the seller's description on their Product page or they do not match the requirements sent to the seller at the beginning of the order process.
    13. You acknowledge, agree, and understand that we encourage our Buyers and Sellers to try and settle conflicts amongst themselves
    14. You acknowledge, agree, and understand that Order cancellations can be performed on FindUsOnWeb, when eligible, by Customer Support or through the Resolution Center per order.
    15. You acknowledge, agree, and understand that filing a transaction dispute or reversing a payment through your payment provider or your bank is a violation to these Terms of Service. Doing so may get your account temporarily or permanently disabled.
    16. You acknowledge, agree, and understand that once you have filed a dispute with your payment provider, the funds will be ineligible for a refund due to our obligations towards the payment provider
    17. You acknowledge, agree, and understand thatin the event that a buyer or seller encounters an issue related to the service provided in an order, you are encouraged to use the Site's dispute resolution tools to attempt to resolve the matter.
    18. You acknowledge, agree, and understand that FindUsOnWeb reserves the right to cancel orders or place funds on hold for any suspected fraudulent transactions made on the Site.
    19. You acknowledge, agree, and understand that all transfer and assignment of intellectual property to the buyer shall be subject to full payment for the Product and the delivery may not be used if payment is cancelled for any reason.
    20. You acknowledge, agree, and understand that If an order is cancelled (for any reason), the funds paid will be refunded to the buyer’s shopping balance.
    21. You acknowledge, agree, and understand that Revisions to deliveries can be performed by Sellers based on the seller’s Product and customer care. Sellers may determine the amount of revisions offered to Buyers, including no revisions.
    22. You acknowledge, agree, and understand that requests for revisions can be performed through the Order page while the order is marked as Delivered.
    23. You acknowledge, agree, and understand that Requesting to gain more services from Sellers beyond the agreed requirements by using the Request Revisions button is not allowed.
    24. You acknowledge, agree, and understand that If for any reason this fails after using the Resolution Center or if you encounter non-permitted usage on the Site, users can contact FindUsOnWeb's Customer Support department for assistance here.
    25. You acknowledge, agree, and understand that FindUsOnWeb encourages Buyers and Sellers to resolve service disputes mutually using the Resolution Center.
    26. You acknowledge, agree, and understand that Eligibility for requests to FindUsOnWeb to cancel an order will be assessed by our Customer Support team based on a number of factors, including violations to our Terms of Service, general misconduct, and improper usage of the FindUsOnWeb delivery system. See below for Order specific eligibility.
    27. You acknowledge, agree, and understand thatCompleted orders (or, where applicable, completed milestones) may be cancelled, upon review of our Customer Support team, up to 14 days after the order (or Milestone) is marked as complete.
    28. You acknowledge, agree, and understand that Orders are not eligible to be cancelled based on the quality of service/materials delivered by the seller if the service was rendered as described in the Product page. Buyers may rate their experience with the seller on the order page, including the overall level of service quality received.
    29. You acknowledge, agree, and understand that buyers must use FindUsOnWeb Resolution Center to address their concerns and desired resolution related to the service provided by their seller prior to contacting Customer Support. Customer Support will not take any action against Orders where the Buyers failed to inform their seller of issues related to the seller’s service and will allow Sellers to provide a resolution first. This does not include non-permitted usage of FindUsOnWeb.
    30. You acknowledge, agree, and understand that any non-permitted usage of FindUsOnWeb encountered during an Order, after being reviewed by our Customer Support team, may result in the order being cancelled. This includes, but not limited to; harassment, unlawful behavior, or other violations to FindUsOnWeb’s Terms of Service.
    31. You acknowledge, agree, and understand that FindUsOnWeb Customer Support will cancel orders based on, but not limited to, the following reasons:
      • Active Orders (after the buyer submits their requirements and before the seller delivers on FindUsOnWeb)
      • The seller is late and unresponsive for more than 24 hours while the order is marked as Late.
      • Users are abusive towards the other party through threats of low ratings or leveraging order materials (such as logins, personal information) against each other.
      • Users supplied or included copyright/trademark infringing materials as part of the Buyer requirements or the seller’s delivery.
      • The user is no longer an active FindUsOnWeb user due to Terms of Service violations or closure of their account.
      • Delivered Orders (after the seller clicks Deliver Now and before the order is marked as complete)
      • The seller uses the Delivery system to extend the delivery due date to complete the requested service without providing the final delivered service to Buyers. Note: Multiple reported offenses will result in permanent suspension of your account.
      • The seller delivers no files and/or proof of work related to the agreed upon order requirements. Note: Subjectivity of the materials in question will be reviewed by our Customer Support team.
      • The seller requests additional payments, on or off the FindUsOnWeb platform, by withholding the final delivery of services directly related to the agreed requirements.
      • The seller is withholding the final delivery of services for improved ratings.
      • Buyers who abuse the Request Revisions button to gain more services from Sellers beyond the agreed requirements.
      • Buyers who threaten to leave a damaging review to gain more services from the seller not related to the agreed requirements.
      • Completed Orders (after the order is marked as complete and before the 14-day limitation)
      • Users who have been reported to use copyright/trademark infringing materials after verification and with proof.
      • Buyers who did not purchase commercial use rights and are reported to have used the materials commercially. Note: Terms of Commercial use is found on the seller’s Product page and cannot be retroactively included once the order is completed for over 14 days.
      • FindUsOnWeb Customer Support will review cases of Order delivery manipulation that prevents Buyers and Sellers from fully utilizing our Resolution Center that enabled the order to be marked as complete.
6.     PAYMENTS
You acknowledge, agree, and understand thatin order to use certain Site Services, Buyer must provide account information for at least one valid Payment Method. Buyer hereby also authorizes FindUsOnWeb, and Cash on Referral Limited to run credit card authorizations on all credit cards provided by Buyer, to store credit card and banking or other financial details as Buyer’s method of payment consistent with our Privacy Policy, and to charge Buyer’s credit card (or any other Payment Method) for the Seller Fees and any other amounts owed under the Terms of Service. To the extent permitted by applicable law and subject to our Privacy Policy, you acknowledge and agree that we may use certain third-party vendors and service providers to process payments and manage your Payment Method information. You acknowledge, agree, and understand thatby providing Payment Method information through the Site and authorizing payments with the Payment Method, Buyer represents, warrants, and covenants that: You acknowledge, agree, and understand thatthe Site and the Site Services operate in British Pounds as Base Currency. If Buyer’s Payment Method is denominated in a currency other than Base currency and requires currency conversion to make payments in Base Currency, the Site may display foreign currency conversion rates that FindUsOnWeb, or our Affiliates currently make available to convert supported foreign currencies to Base Currency. These foreign currency conversion rates adjust regularly based on market conditions. You acknowledge, agree, and understand thatthat the wholesale currency conversion rates at which we or our Affiliates obtain foreign currency will usually be different than the foreign currency conversion rates offered on the Site. Buyer, at its sole discretion and risk, may authorize the charge or debit of its Payment Method in a supported foreign currency and the conversion of the payment to Base Currency at the foreign currency conversion rate displayed on the Site. You acknowledge, agree, and understand thatIf foreign currency conversion is required to make a payment in Base Currency and either FindUsOnWeb or our Affiliates does not support the foreign currency or Buyer does not authorize the conversion of such payment at the foreign currency conversion rate, FindUsOnWeb or one of our Affiliate will charge or debit Buyer’s Payment Method in Base Currency and Buyer’s Payment Method provider will convert the payment at a foreign currency conversion rate selected by Buyer’s Payment Method provider. Buyer’s Payment Method provider may also charge fees directly to the Payment Method even when no currency conversion is involved. You acknowledge, agree, and understand thatBuyer’s authorization of a payment using a foreign currency conversion rate displayed on the Site is at Buyer’s sole risk. FindUsOnWeb, FindUsOnWeb Escrow, and our Affiliates are not responsible for currency fluctuations that occur when billing or crediting a Payment Method denominated in a currency other than Base Currency. FindUsOnWeb, FindUsOnWeb Escrow, and our Affiliates are not responsible for currency fluctuations that occur when receiving or sending payments via wire transfer, check or automated clearinghouse to and from the Escrow Account. You acknowledge and agree that we may in our sole discretion, from time to time, appoint our related bodies corporate, affiliates, or any other third party to act as our agent to accept or make payments (including merchant facilities) from or to Users on our behalf.Such a third party will have the same rights, powers and privileges that we have under this User Agreement and will be entitled to exercise or enforce their rights, powers and privileges as our agent or in their own name. In no event shall we be liable to any User for any loss, damage or liability resulting from the Payment Administration Agent's negligence and/or acts beyond the authority given by FindUsOnWeb. You acknowledge, agree, and understand thatIf Buyer is in “default”, meaning the Buyer fails to pay against an order processes by a seller or any other amounts when due under the Terms of Service, or a written agreement for payment terms incorporating the Terms of Service (signed by an authorized representative of FindUsOnWeb), FindUsOnWeb will be entitled to the remedies described in this agreement in addition to such other remedies that may be available under applicable law or in such written agreement. For the avoidance of doubt, Buyer will be deemed to be in default on the earliest occurrence of any of the following: You acknowledge, agree, and understand that If Buyer is in default, FindUsOnWeb may, without notice, temporarily or permanently close Buyer’s Account and revoke Buyer’s access to the Site and Site Services, including Buyer’s authority to use the Site to process any additional payments, enter into Service Contracts, or obtain any additional Seller Services from other Users through the Site. However, Buyer will remain responsible for any amounts that accrue on any open Jobs at the time a limitation is put on the Buyer’s Account as a result of the default. Without limiting other available remedies, Buyer must pay FindUsOnWeb upon demand for any amounts owed, plus interest on the outstanding amount at the lesser of one and one-half percent (1.5%) per month or the maximum interest allowed by applicable law, plus attorneys’ fees and other costs of collection to the extent permitted by applicable law. You acknowledge, agree, and understand that FindUsOnWeb, at our discretion and to the extent permitted by applicable law, may set off amounts due against other amounts received from Buyer, make appropriate reports to credit reporting agencies and law enforcement authorities, and cooperate with credit reporting agencies and law enforcement authorities in any investigation or prosecution. You acknowledge, agree, and understand that FindUsOnWeb will charge Buyer’s designated Payment Method for the equivalent product or service Fees incurred and that once FindUsOnWeb charges or debits the Buyer’s designated Payment Method for the Fees, the charge or debit is non-refundable, except as otherwise required by applicable law. Buyer also acknowledges and agrees that the Terms of Service provide a dispute resolution process as a way for Buyer resolve disputes. To the extent permitted by applicable law, Buyer therefore agrees not to ask its credit card company, bank, or other Payment Method provider to charge back any Fees or other fees charged pursuant to the Terms of Service for any reason. A chargeback in breach of the foregoing obligation is a material breach of the Terms of Service. If Buyer initiates a chargeback in violation of this Agreement, Buyer agrees that FindUsOnWeb may dispute or appeal the chargeback and institute collection action against Buyer and take such other action it deems appropriate. You acknowledge, agree, and understand thatYou may ask for a refund at any time for any funds that you have paid into your Account except if the amount to refund relates to a Job Payment or relates to fees or charges payable to us. You acknowledge, agree, and understand thatIf we agree to the refund, the funds will be received by the User into the Web account. You acknowledge, agree, and understand thatFindUsOnWeb does not automatically refund payments made for cancelled orders back to your payment provider. You acknowledge, agree, and understand thatFunds from order cancellations are refunded to the buyer's balance as credit and are available for future purchases on FindUsOnWeb. You acknowledge, agree, and understand thatFunds returned to your balance from cancelled orders will not include service fees paid.Deposit refunds, when available from the payment provider, can be performed by our Customer Support team. You acknowledge, agree, and understand thatTo prevent fraud and abuse, we limit the total amount of times users can request a payment provider refund from their account which is subject to review by our Customer Support team. Such refunds may be subject to an additional fee. If any service fees were added at the time of purchase to create a new order, the service fees from that payment will not be refunded along with your deposit. You acknowledge, agree, and understand thatWe may refund funds to Users irrespective of whether a User has requested funds be refunded if: You acknowledge, agree, and understand thatyour withdrawal of funds earned may be delayed for up to fifteen days for security and fraud purposes.withdrawals may also be delayed for up to fifteen days where our fraud prevention policies require a delay.We may impose a minimum withdrawal amount for funds earned. This is set out in our schedule of Fees and Charges . You acknowledge, agree, and understand thatWe may require you to be FindUsOnWeb Verified before you can withdraw funds from your FindUsOnWeb account, irrespective of whether or not a delay has been enforced. For details of how to become FindUsOnWeb Verified please read the Know your Customer and Identity Verification Policy. You acknowledge and agree that we may seek to verify your identity or request additional information from you as part of our anti-fraud and Know Your Customer policy, as outlined in the section on "Identity / Know Your Customer" sections of this agreement. You acknowledge, agree, and understand thatTo withdraw your revenue, you must have an account with at least one of FindUsOnWeb's withdrawal methods.Your FindUsOnWeb profile can be associated with only one account from each FindUsOnWeb withdrawal methods. You acknowledge, agree, and understand thatA withdrawal provider account can be associated with only one FindUsOnWeb profile.Revenues are only made available for withdrawal from the Revenue page following a safety clearance period of 14 days after the order is marked as complete. You acknowledge, agree, and understand thatif you are promoted by the system as a TOP Rated Seller, then as a top rated sellers are eligible to withdraw revenue following a safety clearance period of 7 days after the order is marked as complete. You acknowledge, agree, and understand thatTo withdraw your available revenue, you must click on the designated withdrawal provider to initiate the withdrawal process. Withdrawals can only be made in the amount available to you.Withdrawal fees vary depending on the withdrawal method.You acknowledge, agree, and understand thatWithdrawals are final and cannot be undone. We will not be able to refund or change this process once it has begun. You acknowledge, agree, and understand thatA chargeback (being a challenge to a payment that a User files with their card issuer or financial institution), and any subsequent reversal instruction, is made by the payment product issuer or third parties (such as payment processors) and not by us. We are bound to follow such instructions. You acknowledge and agree that we will be entitled to recover any chargebacks and reversals that may be imposed on us by a payment product issuer or third parties (such as payment processors) on funds paid to you through the Website, as well as any processing or any other fees whatsoever incurred by us on those chargebacks and reversals. You agree that we may reverse any such payments made to you, which are subject to chargeback or reversal instruction via your payment product issuer or third parties (such as payment processors). If you initiate any chargeback request or other "Request for Information" or similar process, you expressly agree and consent to us to share any and all information in relation to your agreement of these terms and conditions, in order to defeat any such chargeback request. You acknowledge, agree, and understand thatsome of the Websites will display rates in the local currency of that Website, in addition to the actual amount. These rates are based on a conversion from the originating currency using indicative market exchange rates. You understand and agree that these rates are only indicative and the amount specified in the origin currency is the actual amount. You acknowledge, agree, and understand thatAs a convenience service, at time of withdrawal, you may withdraw funds from the Website in another currency rather than base currency in accordance with other terms and conditions of this agreement. If you wish to do so, you will be quoted an exchange rate which will be available for the time specified, which you may choose to accept. We may charge a fee for effecting the currency conversion transactions. This fee will be embedded within the rate provided to you and the currency exchange will be settled immediately. You acknowledge, agree, and understand thatwe reserve the right to reject any request for a conversion of currency at any time. You acknowledge, agree, and understand thatYou are responsible for all risks associated with converting and maintaining funds in various available currencies, including but not limited to the risk that the value of these funds will fluctuate as exchange rates change, which could result in decreases in the value of your funds in aggregate. You must not use (or attempt to use) the Website to engage in speculative trading, which could result in substantial losses. We are not a financial services provider. You acknowledge, agree, and understand thatAll information included on the Website in respect of currency conversion is general information only. Use of currency conversion is at your own risk. Currency conversions are final and irreversible.
1.     Payment Methods
You acknowledge, agree, and understand thatWhen Buyer authorizes a payment using a Payment Method via the Site, Buyer represents and warrants that there are sufficient funds or credit available to complete the payment using the designated Payment Method. To the extent that any amounts owed under this Agreement or the other Terms of Service cannot be collected from Buyer’s Payment Method(s), Buyer is solely responsible for paying such amounts by other means. Because the use of any Payment Method may be limited by applicable law or by written agreement with your financial institution, FindUsOnWeb is not liable to any User if FindUsOnWeb does not complete a transaction as a result of any such limit, or if a financial institution fails to honor any credit or debit to or from an account associated with such Payment Method. FindUsOnWeb will make commercially reasonable efforts to work with any such affected Users to resolve such transactions in a manner consistent with this Agreement and any applicable Escrow Instructions.
      • Buyer is legally authorized to provide such information;
      • Buyer is legally authorized to make payments using the Payment Method(s);
      • if Buyer is an employee or agent of a company or person that owns the Payment Method, that Buyer is authorized by the company or person to use the Payment Method to make payments on FindUsOnWeb; and
      • such actions do not violate the terms and conditions applicable to Buyer’s use of such Payment Method(s) or applicable law.

      • Buyer fails to pay the Fees when due,
      • Buyer fails to pay a balance that is due or to bring, within a reasonable period of time but no more than 30 days, an account current after a credit or debit card is declined or expires,
      • Buyer fails to pay an invoice issued to the Buyer by FindUsOnWeb within the time period agreed or, if none, within 30 days,
      • Buyer initiates a chargeback with a bank or other financial institution resulting in a charge made by FindUsOnWeb for Fees or such other amount due being reversed to the Buyer, or
      • Buyer takes other actions or fails to take any action that results in a negative or past-due balance on the Buyer’s account.

You acknowledge, agree, and understand that You can request a refund by using our customer support website or emailing us at support@FindUsOnWeb.com. Once you have made a Job Payment, you expressly agree to use the dispute resolution process in this agreement, expressly agree to be bound by its ruling and expressly agree not to initiate any chargeback request with your card issuer. You acknowledge, agree, and understand thatIf you initiate any chargeback request or other "Request for Information" or similar process, you expressly agree and consent to us to share any and all information in relation to your agreement of these terms and conditions, in order to defeat any such chargeback request. You acknowledge, agree, and understand thatIf you have already initiated a chargeback request with your credit card issuer, you must not request a refund of funds by contacting us and must not seek double recovery. You acknowledge, agree, and understand thatIf we reasonably determine, having considered all the relevant circumstances, that you have made an excessive or unreasonable number of requests to refund funds back to you or chargebacks, we may suspend, limit or close your Account.
      • we are required by law or consider that we are required by law to do so;
      • we determine that refunding funds to the User will avoid any dispute or an increase in our costs;
      • we refund funds to the User in accordance with any refund policy specified by us from time to time;
      • we find out that the original payment made by the User is fraudulent;
      • the User made a duplicate payment in error; or
      • we consider, in our sole opinion, that it is likely that the refund of funds is necessary to avoid a credit card chargeback.

7.     REVIEWS AND RATINGS
    1. Feedback reviews provided by Buyers while completing an order are an essential part of FindUsOnWeb's rating system. Reviews demonstrate the buyer's overall experience with the Sellers and their service. Buyers are encouraged to communicate to the seller any concerns experienced during their active order in regards to the service provided by the seller.
    2. Leaving a buyer's feedback is a basic prerogative of a buyer. Feedback reviews will not be removed unless there are clear violations to our Terms of Service.
    3. To prevent any misuse of our Feedback system, all feedback reviews must come from legitimate sales executed exclusively through the FindUsOnWeb platform from users within our Community. Purchases arranged, determined to artificially enhance seller ratings, or to abuse the FindUsOnWeb platform with purchases from additional accounts, will result in a permanent suspension of all related accounts.
    4. Feedback comments given by Buyers are publicly displayed on a seller’s Product page. Buyers have the option not to include a comment, but still rate the service.
    5. Work Samples are the delivered images and videos sent to a buyer in a delivery message. Work Samples are added to a seller's Live Portfolio on their Product page if the buyer chooses to publish the Work Sample while providing a public feedback review.
    6. Withholding the delivery of services, files, or information required to complete the Product’s service with the intent to gain favourable reviews or additional services is prohibited.
    7. Responding and posting a review: Once work is delivered, the buyer has three days to respond and post a review (or 14 days for Services with shipping). If no response is provided within the response period, the order will be considered completed.
    8. Users are allowed to leave reviews on orders up to 30 days after an order is marked as complete. No new reviews may be added to an order after 30 days.
    9. Sellers may not solicit the removal of feedback reviews from their Buyers through mutual cancellations.
8.     ABUSING FINDUSONWEB
FindUsOnWeb reserves to the greatest extent possible all rights, without limiting any other remedies, to limit, suspend or terminate our service(s) and or user account(s), suspend or ban access to our services, remove any content, and to take any and all technical or legal steps to ban users. Without limiting the reasons for taking the aforementioned actions, conduct giving rise to this response could include: FindUsOnWeb reserves the right to remove credit or remove users from participating in the program if the company determines the users to be acting in bad faith and are abusing the program. To protect our users' privacy, user identities are kept anonymous. Requesting or providing Email addresses, Skype/IM usernames, telephone numbers or any other personal contact details to communicate outside of FindUsOnWeb in order to circumvent or abuse the FindUsOnWeb messaging system or FindUsOnWeb platform is not permitted. Rude, abusive, improper language, or violent messages will not be tolerated and may result in an account warning or the suspension/removal of your account.
      • use of our services for any illegitimate or non-bona fide purpose
      • creating problems with other users or potential legal liabilities
      • infringing the intellectual property rights of third parties
      • acting inconsistently with the letter or spirit of any of our policies
      • abuse of any staff members including inappropriate or unreasonable communications
      • abuse or poor performance in the Preferred FindUsOnWeb Program
      • any attempt to use FindUsOnWeb's platform or services for any objectionable purpose
      • buy or sell FindUsOnWeb accounts.
      • Harrasing other users by means of targeted abuse as we do not tolerate users who engage in targeted abuse or harassment towards other users on FindUsOnWeb. This includes creating new multiple accounts to harass members through our message or ordering system
9.     REVIEWS AND RATINGS
If a Buyer and Seller decide to enter into a Service Contract, the Service Contract is a contractual relationship directly between the Buyer and Seller. Buyer and Seller have complete discretion both with regard to whether to enter into a Service Contract with each other and with regard to the terms of any Service Contract. You acknowledge, agree, and understand that FindUsOnWeb is not a party to any Service Contracts, that the formation of a Service Contract between Users will not, under any circumstance, create an employment or other service relationship between FindUsOnWeb and any Seller or a partnership or joint venture between FindUsOnWeb and any User. With respect to any Service Contract, Buyers and Sellers may enter into any written agreements that they deem appropriate (e.g., confidentiality agreements, invention assignment agreements, assignment of rights, etc.) provided that any such agreements do not conflict with, narrow, or expand FindUsOnWeb’s rights and obligations under the Terms of Service, including this Agreement.
10. CONFIDENTIAL INFORMATION
Users may agree to any terms they deem appropriate with respect to confidentiality. If and to the extent that the Users do not articulate any different agreement, then they agree that this confidential information section of the agreement applies.To the extent a User provides Confidential Information to the other, the recipient will protect the secrecy of the discloser’s Confidential Information with the same degree of care as it uses to protect its own Confidential Information, but in no event with less than due care. On a User’s written request, the party that received Confidential Information will promptly destroy or return the disclosing party’s Confidential Information and any copies thereof contained in or on its premises, systems, or any other equipment otherwise under its control.
11. WORKER CLASSIFICATION
Nothing in this Agreement is intended to or should be construed to create a partnership, joint venture, franchisor/franchisee or employer-employee relationship between FindUsOnWeb and a User.
Buyer is solely responsible for and has complete discretion with regard to selection of any Seller for any Job. Buyer is solely responsible, warrants its decisions regarding classification are correct, and assumes all liability, for determining whether Sellers should be engaged as independent contractors or employees of Buyer and engaging them accordingly; FindUsOnWeb will have no input into, or involvement in, worker classification as between Buyer and Seller and Users agree that FindUsOnWeb has no involvement in and will have no liability arising from or relating to the classification of a Seller generally or with regard to a particular Job.
12. NO INTEREST
You agree that you will not receive interest or other earnings on the funds available in your credit account with us or on FindUsOnWeb site.
13. CREDIT PROMOTIONS
This section related to all promotions of free site credit provided under any program, including but not limited to the Referral Program. From time to time, FindUsOnWeb may provide site credits limited to certain users as a promotion. In these cases, the credit may be given in the form of coupon links or codes, emails, sms or advertisements or increase in a Credit balance to be used for future spending subject to the following conditions:
    1. All members of the program are subject to all other terms and conditions of the website, which in case of dispute, this section will prevail over.
    2. All members of the program must be over the age of 16 years.
    3. Users may be asked to provide verification of payment or other user information before receiving the credit.
    4. Any site credit that has been given in relation to this promotion may expire at any time determined by the Company.
    5. Any site credit will expire no longer than 30 days unless otherwise written on the promotion.
    6. This site credit may only be used for the purpose of establishing a Job Payment, funding a prize for a new Contest, or payment of site fees including but not limited to Job fees, contest fees, upgrades and memberships.
    7. FindUsOnWeb may require that redeeming users fill in and complete their profiles and/or pass identity checks before payments are released.
    8. This promotion may be withdrawn for a specific user or set of users, if significant reversals, fraud or chargebacks are observed, if FindUsOnWeb believes that there is a risk of funds being subject to reversal or chargeback, in cases of disputes, or for any other reason.
    9. For any specific user, FindUsOnWeb may choose to cap the maximum value of site credit accrued by an individual or collection of related individuals.
    10. For avoidance of any doubt, no individual or collection of related individuals may accumulate more than US$5,000 of site credit.
    11. FindUsOnWeb reserves the right to disallow use of this promotion in its sole and absolute discretion, with respect to fair use of this promotion, or to prevent any suspected fraud.
    12. FindUsOnWeb reserves the right to require submission of further information from any party applying to make use of this promotion, for investigating fraud and for risk management and related purposes, in particular to request evidence of bona fide work being done in relation to any Job or Contest funded with the site credit.
    13. FindUsOnWeb reserves the right to cancel or amend this promotion at any time.
    14. FindUsOnWeb reserves the right to cancel the promotion in any region if it is deemed or becomes unlawful to offer the promotion to any resident of that region.
    15. FindUsOnWeb reserves the right to cap the total site credit available under the program.
    16. For avoidance of any doubt, the total site credit available under any program is capped to US$20,000.
    17. Any site credit may not be duplicated, sold, traded or transferred in any manner, including but not limited to being withdrawn for cash.
    18. The decisions of management are final. No correspondence will be entered into.
    19. Management, employees of FindUsOnWeb and its related companies are not eligible to participate in this program.
    20. Any term or condition in these terms found to be void, unenforceable or illegal may be severed and the remaining terms and conditions will continue in full force and effect.
    21. FindUsOnWeb reserves the right to set the bonus credits for each individual user and to release said bonus credit in any currency the company sees fit.
    22. FindUsOnWeb is not liable for any loss or damage whatsoever which is suffered (including but not limited to, direct or consequential loss) or for any personal injury suffered or sustained in connection with entry into the competition or acceptance of the prize.
14. REFERRAL PROGRAM
For a limited promotional period, FindUsOnWeb will provide site credits or reduced fees limited to certain users as a reward for referrals of new Buyer users. The promotion is based on existing users of the website ("Referrers") referring new Buyer users ("Referees") with the intention to post their first job. In some cases, the credit may be given in the form of coupon links or codes, where the Referrer in that case is the website itself. Please see refer and reward terms for details
15. ADVERTISING
Unless otherwise agreed with us, you must not advertise an external website, product or service on the Website. Any website address posted on the Website, including in a listing, bid, listing description, clarification board or the message board, must relate to a Job, Contest, item listed, user or service being performed on the Website. We may display advertisements or promotions on the Website. You acknowledge and agree that we shall not be responsible for any loss or damage of any kind incurred by you as as result of the presence of such advertisements or promotions or any subsequent dealings with third parties. Furthermore, you acknowledge and agree that content of any advertisements or promotions may be protected by copyrights, trademarks, service marks, patents or other intellectual property or proprietary rights and laws. Unless expressly authorised by FindUsOnWeb or third party right holders, you agree not to modify, sell, distribute, appropriate or create derivative works based on such advertisement/promotions.
16. 16. COMMUNICATION WITH OTHER USERS
Communication with other users on the Website must be conducted through the text, audio and or video chat functionality, along with message boards, public clarification boards, Job message board, direct message sending and other communication channels provided on the Website. You must not post your email address or any other contact information (including but not limited to Skype ID or other identifying strings on other platforms) on the Website, except in the "email" field of the signup form, at our request or as otherwise permitted by us on the Website. Unless you have a prior relationship with a User, you must only communicate with Users via the Website. You must not, and must not attempt to, communicate with other Users through any other means including but not limited to email, telephone, Skype, ICQ, AIM, MSN Messenger, WeChat, SnapChat, GTalk, GChat or Yahoo. In relation to video chat and audio chat, any terms agreed to between any Users must be confirmed in writing using the chat or direct message function. FindUsOnWeb may use information such as your name, location, display or username, and or your image, in relation to the provision messaging services on the Website or in the mobile apps. We may read all correspondence posted to the Website and download or access, and test (if necessary), all uploaded files, programs and websites related to your use of the Website for the purpose of investigating fraud, regulatory compliance, risk management and other related purposes
17. IDENTITY / KNOW YOUR CUSTOMER
You authorise us, directly or through third parties, to make any inquiries we consider necessary to validate your identity. You must, at our request: (1) provide further information to us, which may include your date of birth and or other information that will allow us to reasonably identify you; (2) take steps to confirm ownership of your email address or financial instruments; or (3) verify your information against third party databases or through other sources. You must also, at our request, provide copies of identification documents (such as your passport or drivers' licence). We may also ask you to provide photographic identification holding a sign with a code that we provide as an additional identity verification step. We reserve the right to close, suspend, or limit access to your Account, the Website and/or FindUsOnWeb Services in the event we are unable to obtain or verify to our satisfaction the information which we request under this section. We reserve the right to update your particulars on the website in order to match any KYC documentation that has been provided. Disbursements such as wire transfers from the website may only be made to the beneficiary matching your provided KYC documents and account information. If you are not FindUsOnWeb verified you may not be able to withdraw funds from your FindUsOnWeb account, and other restrictions may apply. See the Know Your Customer and Identity Verification Policy for more details.
18. SPECIAL PROVISIONS FOR JOBS
Each User acknowledges:
    1. FindUsOnWeb does not review, approve, recommend or verify any of the credentials, licences or statements of capability in relation to Local Jobs (or, for the avoidance of doubt, any non Local Jobs on the Website);
    2. FindUsOnWeb provides matchmaking and platform services only. Users agree that FindUsOnWeb has no liability for any other aspect of service delivery or interaction between Buyer and Seller. FindUsOnWeb is not a party to any disputes between Buyer and Seller, although we provide a dispute resolution mechanism to assist the parties in resolving issues;
    3. FindUsOnWeb may from time to time include map features and FindUsOnWeb may display the location of Users to persons browsing the Website on that map. Every Buyer seeking services for Local Jobs will be asked to provide the location where the Local Job is to be performed. You expressly agree that FindUsOnWeb has no liability for displaying such information
    4. A User must never disclose, in any Job posted, personal details such as the User's name, street number, phone number or the email address in any Job description for a Local Job or in any other public communication on the Website (these may be disclosed for Local Jobs as required in private direct messages);
    5. FindUsOnWeb may collect location related data from you via technologies including but not limited to GPS, IP address location, wifi, and other methods. This data may be shared in the context of facilitating services for Local Jobs and each User specifically consents to this collection and sharing as part of this agreement;
    6. Upon completion of a Local Job Job, Seller User must log on to the Website and click the "Complete" button for that Local Job, as soon as practicable.
    7. Failure to complete the service or task will constitute a breach of this User Agreement; and
    8. Our fees are applied to the amount of the awarded Seller's bid to perform the services for the Local Job. Any items purchased by the Seller as part of performing the service are between the Buyer and Seller.
19. USER SERVICES
Upon the Buyer awarding a Job or Contest to the Seller, and the Seller's acceptance on the Website, or the purchase of an item by a Buyer from the Seller, the Buyer and Seller will be deemed to have entered into a User Contract under which the Buyer agrees to purchase, and the Seller agrees to deliver the Seller Services. You agree not to enter into any contractual provisions in conflict with the User Agreement. You are solely responsible for ensuring that you comply with your obligations to other Users. If you do not, you may become liable to that User. You must ensure that you are aware of any domestic laws (including common law), international laws, statutes, ordinances and regulations relevant to you as a Buyer or Seller, or in any other uses you make of the Website. If another User breaches any obligation to you, you are solely responsible for enforcing any rights that you may have. For the avoidance of doubt, we have no responsibility for enforcing any rights under a User Contract. Depending on their jurisdiction, Sellers and Buyers may have rights under statutory warranties that cannot lawfully be excluded. Nothing in this User Agreement is intended to override a right that by applicable law may not be excluded. Nothing in this User Agreement is intended to violate any laws relating to unfair contracts, and this agreement has been specifically redrafted to ensure compliance with unfair contracts legislation. To the extent that any component of this User Agreement is in conflict with inalienable rights under local laws, all parties intend for this agreement to be read down only insofar as to be in compliance with such local laws and no further. Each User acknowledges and agrees that the relationship between Buyers and Sellers is that of an independent contractor. Nothing in this User Agreement creates a partnership, joint venture, agency or employment relationship between Users. Nothing in this User Agreement shall in any way be construed as forming a joint venture, partnership or an employer-employee relationship between FindUsOnWeb and any User.
20. ACCOUNT FUNDS
You may have positive funds in your Account if you have prepaid & purchased credit via for fees or charges or for services to be provided to you via the Website or earned promotional Credit and rewards. If you are a Seller, you may have positive funds if you have successfully completed a Job, or sold an item, and funds have been released to you. There are also circumstances where funds may have been credited to your Account in relation to an affiliate program or a referral program. You are not entitled to any interest, or other earnings for funds that are in your Account. If your Account has negative funds, we may:
    • set-off the negative amount with funds that you subsequently receive into your Account;
    • if you have funds in multiple currencies in your Account and one of the currencies becomes negative for any reason, we may set-off the negative amount against funds you maintain in a different currency (at an exchange rate applied by us);
    • reverse payments you have made from your Account to other User Accounts on the Website;
    • deduct amounts you owe us from money you subsequently add or receive into your Account; or
    • immediately suspend or limit your Account until such time as your Account no longer has a negative amount
In the event that we offset a negative amount of funds pursuant to this section, it may be bundled with another debit coming out of your Account. We reserve the right to collect any funds owed to us by any other legal means. You acknowledge and agree that:
    • we are not a bank or other licensed financial institution and do not provide banking services or any financial services to you;
    • the funds shown in your Account (which may include Job Payments and/or any prepayment of fees and charges which you owe to us) represents the credits available to you and our unsecured obligations to you with respect to your rights to direct us to make payment in relation to the purchase and sale of Seller Services through the Website and provision of the FindUsOnWeb Services;
    • if you were a User acquired in an acquisition and your account was migrated to the Website, we are responsible for your positive funds only to the extent of the egal documentation between us and any acquired marketplace, along with this agreement, and you acknowledge specifically that the onus is on you to confirm the validity of your fund, and that any understatement or misstatement in relation to this is not a claim against us, and belongs with the counterparty of any prior user agreement to which you agreed;
    • to the extent that we are required to release funds from your Account to you, you will become our unsecured creditor until such funds are paid to you;
    • we are not acting as a trustee or fiduciary with respect to such funds or payments;
    • the amount of funds showing in your Account is not insured and is not a guaranteed deposit but can be withdrawn from to your originated bank account on Request in accordidence with other terms and conditions of this agreement;
    • funds may only loaded into your Account, or released from your Account, by us and you must only use the mechanisms available on the Website to pay for, or receive funds in respect of Seller Services;
    • any refunds required to be processed in your favour will be returned only to the source of the original deposit, and cannot be redirected to any other payment source;
21. LIMITS & FRAUD PREVENTION
We reserve the right to suspend a User withdrawal request if the source of the funds is suspected to be fraudulent.If we become aware that any funds received into an Account from another Account as a result of a fraudulent transaction, this will be reversed immediately. If those funds have already been released to you, you must pay the funds into your Account. If you do not do so, we may suspend, limit or cancel your account, or take action against you to recover those funds. We may, in our sole discretion, place a limit on any or all of the funds in your Account (thereby preventing any use of the funds) if: If you are involved in a dispute, we may (in certain circumstances) place a temporary limit on the funds in your Account to cover the amount of any potential liability. If the dispute is resolved in your favour, we will lift the limit on your funds and those funds may be released to you. If the dispute is not resolved in your favour, we may remove the funds from your Account. We may also place a limit on your account in circumstances where we suspect you of fraudulent or other unacceptable behaviour, while we investigate any such matter.
    1. we believe there may be an unacceptable level of risk associated with you, your Account, or any or all of your transactions, including if we believe that there is a risk that such funds will be subject to reversal or chargeback;
    2. we believe that the beneficiary of the payment is someone other than you;
    3. we believe that the payment is being made to a country where we do not offer our Service; or
    4. we are required to do so by law or applicable law enforcement agencies.
22. RIGHT TO REFUSE SERVICE
We reserve the right to suspend a User withdrawal request if the source of the funds is suspected to be fraudulent.If we become aware that any funds received into an Account from another Account as a result of a fraudulent transaction, this will be reversed immediately. If those funds have already been released to you, you must pay the funds into your Account. If you do not do so, we may suspend, limit or cancel your account, or take action against you to recover those funds. We may, in our sole discretion, place a limit on any or all of the funds in your Account (thereby preventing any use of the funds) if:
    1. we believe there may be an unacceptable level of risk associated with you, your Account, or any or all of your transactions, including if we believe that there is a risk that such funds will be subject to reversal or chargeback;
    2. we believe that the beneficiary of the payment is someone other than you;
    3. we believe that the payment is being made to a country where we do not offer our Service; or
    4. we are required to do so by law or applicable law enforcement agencies.
If you are involved in a dispute, we may (in certain circumstances) place a temporary limit on the funds in your Account to cover the amount of any potential liability. If the dispute is resolved in your favour, we will lift the limit on your funds and those funds may be released to you. If the dispute is not resolved in your favour, we may remove the funds from your Account. We may also place a limit on your account in circumstances where we suspect you of fraudulent or other unacceptable behaviour, while we investigate any such matter.
23. BUYERS BASICS
In order to access the services as Buyer, you acknowledge & agree to following terms:
    1. You must not offer direct payments to Sellers using payment systems outside of the FindUsOnWeb Order system.
    2. FindUsOnWeb retains the right to use all publically published delivered works for FindUsOnWeb marketing and promotional purposes.
    3. You may request a specific service from the Post a Request feature found from the website. Services requested on FindUsOnWeb must be an allowed service on FindUsOnWeb. Users should refrain from using the Post a Request feature for any purpose other than looking for services on FindUsOnWeb.
    4. You pay FindUsOnWeb to create an order from a seller’s Product page or Custom Offer, using the Order Now button.
    5. In additionyou can request a Custom Order which addresses specific buyer requirements, and receive a Custom Offer from Sellers through the site or through FindUsOnWeb Anywhere.
    6. Services may be purchased using one of the following payment methods: Credit Card, PayPal or FindUsOnWeb Credit.
    7. Service fees may get added at the time of purchase where a buyer can review and accept the total amount requested to pay. These fees can cover administrative fees. When purchasing from your shopping balance (resulting from any credits or refunds) you will not be charged a service fee. Funds returned to your balance from cancelled orders will not include service fees paid.
    8. If you have funds in your account balance, either from your Shopping or available Revenue balance, it will be automatically applied to your next purchase.
    9. In certain locations we may charge you in their local currency. Buyers should note, however, that the Services’ local pricing is derived from converting their original base currency price and, therefore, local currency prices may change daily in accordance with exchange rates fluctuations.
    10. You may not offer Sellers to pay, or make payment using any method other than through the FindUsOnWeb.com site. In case you have been asked to use an alternative payment method, please report it immediately to Customer Support here .
    11. To protect against fraud, unauthorized transactions (such as money laundering), claims or other liabilities, we do not collect credit information; but allow our payment vendors to collect information for the purpose of collecting payments from Buyers on the Site or transferring payments to Sellers on the Site. We are not exposed to the payment information provided to our payment vendors, and this information is subject to the privacy policy applicable to the payment vendor. Please see our Privacy Policy for more information here.
    12. By using any payment method and/or providing payment details for making purchases on FindUsOnWeb, you represent and warrant that: (a) you are legally authorized to provide such information; (b) you are legally authorized or have permission to make payments using the payment method(s); (c) if you are an employee or agent of a company or person that owns the payment method, you are authorized by that company or person to use the payment method to make payments on FindUsOnWeb; and (d) such actions do not violate any applicable law.
24. SELLER BASICS
    • Sellers Advertise and promote products and services on FindUsOnWeb to allow Buyers to purchase their services.
    • Sellers may also offer Custom orders to Buyers in addition to their Services.
    • Each order you sell and successfully complete, accredits your account with a net revenue between 75% to 83% of the purchase amount depending on the membership level you are on at the time of completion of the job.
    • FindUsOnWeb accredits Sellers once an order is completed. See our "Orders" section below for a definition of a completed order.
    • If an order is cancelled (for any reason), the funds paid will be refunded to the buyer’s Shopping Balance.
    • Revenues are only made available for withdrawal from the Revenue page following a safety clearance period of 14 days after the order is marked as complete. Top Rated Sellers are eligible to withdraw revenue following a safety clearance period of 7 days after the order is marked as complete.
    • Sellers may withdraw their revenues using one of FindUsOnWeb’s withdrawal options.
    • The seller's rating is calculated based on the order reviews posted by Buyers. High ratings allow Sellers to obtain advanced seller levels (see Levels below). In certain cases, exceedingly low ratings may lead to the suspension of the Seller’s account.
    • For security concerns, FindUsOnWeb may temporarily disable a seller’s ability to withdraw revenue to prevent fraudulent or illicit activity. This may come as a result of security issues, improper behavior reported by Buyers, or associating multiple FindUsOnWeb accounts to a single withdrawal provider.
    • Services created on FindUsOnWeb are User Generated Content.
    • Services may be removed by FindUsOnWeb for violations to these Terms of Service, which may include (but are not limited to) the following violations and/or materials:
    • Illegal or Fraudulent services
    • Copyright Infringement, Trademark Infringement, and violation of a third party's terms of service reported through our Intellectual Property Claims Policy found here
    • Adult oriented services, Pornographic, Inappropriate/Obscene
    • Intentional copies of Services
    • Spam, Nonsense, or Violent Services
    • Services misleading to Buyers
    • Reselling of regulated goods
    • Offering to prepare academic works on behalf of Buyers
    • Services that extend beyond 30 days of service duration
    • Exceedingly low qualityServices
    • Services that are removed for violations mentioned above, may result in the suspension of the Seller’s account.
    • Services that are removed for violations are not eligible to be restored or edited.
    • Services may be removed from our Search feature due to poor performance and/or user misconduct.
    • Services may include pre-approved website URLs contained within the Product description and requirements box. Services containing websites promoting content, which violates FindUsOnWeb’s Terms of Service, will be removed.
    • Services are required to have an appropriate Product image related to the service offered. An option to upload two additional Product images are available to all Sellers. Sellers must deliver the same quality of service as shown on their Product images. Recurring deliveries that don’t match the quality shown on the Product images may lead to the Seller’s account losing seller status or becoming permanently disabled.
    • Services may contain an approved Product Video uploaded through the Product management tools available on FindUsOnWeb.
    • Statements on the Product Page that undermine or circumvent these Terms of Service is prohibited.
    • Eligible Services and Sellers may price their Services at a base price beyond £1. Base prices on Servicesshould be a positive value greater than or equal to base process.
    • Eligible Services in select Categories may set up Product Packages to offer their services in structured formats with multiple price points for the selected Product.
25. SELLER LEVELS
FindUsOnWeb is all about helping Sellers leverage their skills, Promoting their business and Helping them grow by meand of completing more customer orders. We seek to empower top performing Sellers with helpful tools to grow their business. Sellers who invest in self-promotion may achieve greater customer satisfaction. And, if they deliver on time and maintain high quality and ratings, FindUsOnWeb may reward them with new statuses, special opportunities, benefits, and tools that come with it.
    • FindUsOnWeb Sellers can gain account Levels based on their activity, performance and reputation. The advancement criteria can be found here.
    • Advancement in Levels are updated periodically by an automated system.
    • The current Levels a seller can achieve are, Level 1, 2, and Top Rated.
    • Sellers who cannot maintain their high quality service, experience a severe drop in ratings, or stop delivering on time risk losing their seller status and the benefits that come with it. For example, late deliveries, warnings to the seller’s account and cancellations can cause a seller to move to a different Level.
    • Advanced levels provide their owners with additional benefits, including offering Services for higher prices through Product Extras, or selling their Product in multiples.
26. ACCESS AND INTERFERENCE
You agree that you will not use any robot, spider, scraper or other automated means to access the Website via any means, including for the avoidance of doubt access to our API or application programming interface, for any purpose without our express written permission.Additionally, you agree that you will not:
    1. take any action that imposes or may impose (in our sole discretion, exercised reasonably) an unreasonable or disproportionately large load on our infrastructure;
    2. interfere with, damage, manipulate, disrupt, disable, modify, overburden, or impair any device, software system or network connected to or used (by you or us) in relation to the Website or your Account, or assist any other person to do any of these things, or take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;
    3. copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for your information) from the websites without the prior express written permission of FindUsOnWeb and the appropriate third party, as applicable;
    4. interfere or attempt to interfere with the proper working of the Websites, services or tools, or any activities conducted on or with the Websites, services or tools; orbypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Website.
27. WARRANTY DISCLAIMER
YOU AGREE NOT TO RELY ON THE SITE, THE SITE SERVICES, ANY INFORMATION ON THE SITE OR THE CONTINUATION OF THE SITE. THE SITE AND THE SITE SERVICES ARE PROVIDED “AS IS” AND ON AN “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER FINDUSONWEB NOR ANY PERSON ASSOCIATED WITH FINDUSONWEB MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY OR AVAILABILITY OF THE WEBSITE.FINDUSONWEB MAKES NO REPRESENTATIONS OR WARRANTIES WITH REGARD TO THE SITE, THE SITE SERVICES, WORK PRODUCT, OR ANY ACTIVITIES OR ITEMS RELATED TO THIS AGREEMENT OR THE TERMS OF SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FINDUSONWEB DISCLAIMS ALL EXPRESS AND IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. You also agree that unless both you and FindUsOnWeb expressly agree otherwise in writing, either of us may terminate this Agreement in our sole discretion, at any time, without explanation, upon written notice to the other, which will result in the termination of the other Terms of Service as well, except as otherwise provided herein. You may provide written notice to here. In the event you properly terminate this Agreement, your right to use the Site and Site Services is automatically revoked, and your Account will be closed. FindUsOnWeb is not a party to any Service Contract between Users. Consequently, User understands and acknowledges that termination of this Agreement (or attempt to terminate this Agreement) does not terminate or otherwise impact any Service Contract or Jobentered into between Users. If you attempt to terminate this Agreement while having one or more open Jobs, you agree (a) you hereby instruct FindUsOnWeb to close any open contracts; (b) you will continue to be bound by this Agreement and the other Terms of Service until all such Jobs have closed on the Site; (c) FindUsOnWeb will continue to perform those Site Services necessary to complete any open Job or related transaction between you and another User; and (d) you will continue to be obligated to pay any amounts accrued but unpaid as of the date of termination or as of the closure of any open Service Contracts, whichever is later, to FindUsOnWeb for any Site Services or such other amounts owed under the Terms of Service and to any Sellers for any Seller Services. Without limiting FindUsOnWeb’s other rights or remedies, we may, but are not obligated to, temporarily or indefinitely revoke access to the Site or Site Services, deny your registration, or permanently revoke your access to the Site and refuse to provide any or all Site Services to you if: (i) you breach the letter or spirit of any terms and conditions of this Agreement or any other provisions of the Terms of Service; (ii) we suspect or become aware that you have provided false or misleading information to us; or (iii) we believe, in our sole discretion, that your actions may cause legal liability for you, our Users, or FindUsOnWeb or our Affiliates; may be contrary to the interests of the Site or the User community; or may involve illicit or illegal activity. If your Account is temporarily or permanently closed, you may not use the Site under the same Account or a different Account or reregister under a new Account without FindUsOnWeb’s prior written consent. If you attempt to use the Site under a different Account, we reserve the right to reclaim available funds in that Account and/or use an available Payment Method to pay for any amounts owed by you to the extent permitted by applicable law. You acknowledge and agree that the value, reputation, and goodwill of the Site depend on transparency of User’s Account status to all Users, including both yourself and other Users who have entered into Service Contracts with you. You therefore agree as follows: IF FINDUSONWEB DECIDES TO TEMPORARILY OR PERMANENTLY CLOSE YOUR ACCOUNT, FINDUSONWEB HAS THE RIGHT WHERE ALLOWED BY LAW BUT NOT THE OBLIGATION TO: (A) NOTIFY OTHER USERS THAT HAVE ENTERED INTO SERVICE CONTRACTS WITH YOU TO INFORM THEM OF YOUR CLOSED ACCOUNT STATUS, (B) PROVIDE THOSE USERS WITH A SUMMARY OF THE REASONS FOR YOUR ACCOUNT CLOSURE. YOU AGREE THAT FINDUSONWEB WILL HAVE NO LIABILITY ARISING FROM OR RELATING TO ANY NOTICE THAT IT MAY PROVIDE TO ANY USER REGARDING CLOSED ACCOUNT STATUS OR THE REASON(S) FOR THE CLOSURE.
42. ACCOUNT DATA ON CLOSURE
Except as otherwise required by law, if your Account is closed for any reason, you will no longer have access to data, messages, files, or other material you keep on the Site and that that any closure of your Account may involve deletion of any content stored in your Account for which FindUsOnWeb will have no liability whatsoever. FindUsOnWeb, in its sole discretion and as permitted or required by law, may retain some or all of your Account information.

    • All information and file exchanges must be performed exclusively on FindUsOnWeb's platform.
    • FindUsOnWeb is open to everyone. Discrimination against a community member based on gender, race, age, religious affiliation, sexual preference or otherwise is not acceptable and may result in the suspension/removal of your account.
    • Users may not submit proposals or solicit parties introduced through FindUsOnWeb to contract, engage with, or pay outside of FindUsOnWeb.
    • Users with the intention to defame competing Sellers by ordering from competing services will have their reviews removed or further account status related actions determined by review by our Trust & Safety team.
    • Users are to refrain from spamming or soliciting previous Buyers or Sellers to pursue removing/modifying reviews or cancelling orders that do not align on Order Cancellation or Feedback policies.
    • FindUsOnWeb reviews cases of payment provider chargebacks and disputes on behalf of Sellers. Although results vary per case due to each chargeback reason, we work hard on resolving disputes in the seller’s favor. If the chargeback case allows, FindUsOnWeb will return parts or full revenue back to Sellers.
    • Users may report Services to Customer Support that may be in violation of FindUsOnWeb’s Terms of Service based on the reported Product’s replicated similarity to pre-existing services (copycat Services).
    • Sellers warrant that any content included in their Services shall be original work conceived by the Sellers and shall not infringe any third party rights, including, without limitation, copyrights, trademarks or service marks. In the event that certain music or stock-footage media are incorporated within the Services, Sellers represent and warrant that they hold a valid license to use such music and/or footage and to include them in the Services.

44. OWNERSHIP
Ownership and limitations: Unless clearly stated otherwise on the seller's Product page/description, when the work is delivered, and subject to payment, the buyer is granted all intellectual property rights, including but not limited to, copyrights for the work delivered from the seller, and the seller waives any and all moral rights therein. The delivered work shall be considered work-for-hire under the U.S. Copyright Act. In the event the delivered work does not meet the requirements of work-for-hire or when US Copyright Act does not apply, the seller expressly agrees to assign to buyer the copyright in the delivered work. All transfer and assignment of intellectual property to buyer shall be subject to full payment for the Product and the delivery may not be used if payment is cancelled for any reason. If you intend to use it for any charge or other consideration, or for any purpose that is directly or indirectly in connection with any business, or other undertaking intended for profit, you will need to buy the Commercial Use License through a Product Extra and will have broader rights that cover your business use. For Voice Over Services, when the work is delivered, and subject to payment, the buyer is purchasing basic rights, (which means the buyer is paying a one time fee allowing them to use the work forever and for any purpose except for commercials, radio, television and internet commercial spots). If you intend to use the Voice Over to promote a product and/or service (with the exception of paid marketing channels), you will need to purchase the Commercial Rights (Buy-Out) through Product Extra. If you intend to use the Voice Over in radio, television and internet commercials, you will need to purchase the Full Broadcast Rights (Buy-Out) through Product Extra. For further information on the type of buy-outs, please read below. Sellers further confirm that whatever information they receive from the buyer, which is not public domain, shall be kept confidential and shall not be shared or used for any purpose whatsoever other than for the delivery of the ordered work to the buyer. Furthermore, users (both Buyers and Sellers) agree that unless they explicitly indicate otherwise, the content users voluntarily create/upload to FindUsOnWeb, including Product texts, photos, videos, usernames, user photos, user videos and any other information, including the display of delivered work, may be used by FindUsOnWeb for no consideration for marketing and/or other purposes.
45. VOICE OVER COMMERCIAL BUY-OUT
When purchasing a Voice Over Product, the Seller grants you a perpetual, exclusive, non-transferable, worldwide license to use the purchased Voice Over (except for commercials, radio, television and internet commercial spots). By purchasing a Commercial Rights (Buy-Out) with your order, in addition to the basic rights, the Seller grants you with a license to use the Voice Over for any corporate, promotional and non-broadcast purposes. Corporate, promotional and non-broadcast purposes means any business related use for the creation of, or to promote a for-product profit or service (with the exception of paid marketing channels), such as (by way of example): explainer videos posted to company websites, social networks or email campaigns, audiobooks, podcast intros, and strictly excludes any illegal, immoral or defamatory purpose. ENTIRE AGREEMENT
This Agreement, together with the other Terms of Service, sets forth the entire agreement and understanding between you and FindUsOnWeb relating to the subject matter hereof and thereof and cancels and supersedes any prior or contemporaneous discussions, agreements, representations, warranties, and other communications between you and us, written or oral, to the extent they relate in any way to the subject matter hereof and thereof. The section headings in the Terms of Service are included for ease of reference only and have no binding effect. Even though FindUsOnWeb drafted the Terms of Service, you represent that you had ample time to review and decide whether to agree to the Terms of Service. If an ambiguity or question of intent or interpretation of the Terms of Service arises, no presumption or burden of proof will arise favouring or disfavouring you or FindUsOnWeb because of the authorship of any provision of the Terms of Service.
